As a licensed tax law specialist Mr. Stefan Winheller mainly
advises German and US charitable organizations and foundations
on nonprofit tax law issues as well as the law of charitable
giving and international grantmaking. Highly experienced in
the nonprofit field, Mr. Winheller is a legal and tax counsel
for major nonprofit organizations within and without Germany.
Specifically, he accompanies foreign charities when it comes
to setting up branches or subsidiaries in Germany. He also
advises high net-worth individuals in the US if they are interested
in donating their monies to German charities and nontheless
want to deduct their contributions under the US tax laws ("international
grantmaking").
Mr. Winheller is also in charge of the firm´s US securities
litigation department and advises European institutional investors
(including private foundations) on their rights and responsibilities
with regard to US securities class actions. Together with
Mr. Warkentin he initiates US class actions in close coordination
with our partner law firm Schiffrin
Barroway Topaz & Kessler, LLP, Philadelphia (USA).
Mr. Winheller studied law at the Universities of Heidelberg,
Bielefeld, Speyer and Cologne with a major in tax law. After
being admitted to the German Bar, he completed his postgraduate
studies in US tax law as a merit scholarship recipient
at Golden Gate
University, San Francisco (USA) and received his LL.M.
in Taxation degree "with honors". During his stay
abroad Mr. Winheller did intensive studies on the law of taxation
of US nonprofit organizations. In his dissertation-thesis
in process he examines the differences and similarities of
the nonprofit tax laws in Germany and the US. Mr. Winheller
is one of the founders and the current CEO of American Friends
of Germany, Inc., a US-based charity that supports German
charities in their fundraising efforts in the US.
Mr. Winheller has published numerous articles and regularly
gives lectures in his fields of speciality. He is the founder
and the managing partner of Winheller Attorneys at Law and
as such in charge of the strategic and international development
of the firm.
