Tax criminal law is one of the most frequently amended regulations in the German tax code. Tax evasion can therefore happen very quickly and often does not even require a great deal of criminal energy.
Anyone who intentionally provides the German tax authorities with incorrect or incomplete information or withholds relevant facts in order to gain tax benefits for himself or a third party can be made liable to tax evasion. In addition to the classic tax reduction, tax benefits can also include unjustly obtained benefits (e.g. child benefit), bonuses or allowances.
Tax evasion is punished with a fine or even imprisonment of up to five years and, in particularly severe cases, up to ten years. The amount of the penalty is based on the amount evaded.
An initiated criminal tax procedure or investigations of the tax investigation often trigger existential fears - both among private individuals and among entrepreneurs. It is therefore particularly important that those affected contact their advisor as soon as possible and carefully plan the next steps for a defense. This is the only way to minimize the consequences of criminal proceedings.
